  1. These General Terms and Conditions (hereinafter “GTC”) apply to the purchase of all products offered by BSC / Bayirli Swiss Company. The buyer’s general terms and conditions are not deemed to be agreed upon. The same applies to any amendments to these GTC unless we have accepted them in writing. The version provided to the buyer at the time of purchase or order shall prevail.
  2. The products are generally delivered according to samples, illustrations, or sketches. Minor deviations in size, color, structure, and workmanship are reserved. Deviations are unavoidable, particularly in the case of repeat or supplementary orders, unless otherwise agreed in writing.
  3. The products are intended exclusively for private use unless otherwise agreed in writing. BSC / Bayirli Swiss Company grants the statutory warranty for design and material defects for a period of two years from the date of delivery of the goods to the buyer. Other warranties and guarantees, in particular BSC / Bayirli Swiss Company does not provide any manufacturer’s warranties unless explicitly stated otherwise in the purchase contract or order confirmation.
  4. The buyer must inspect the products immediately upon receipt for any defects, especially glass damage. Any complaints must be made within 8 days of receipt of the products. Defects that become apparent later, i.e., during the warranty period, must be reported immediately upon discovery. Excluded from the warranty are damage caused by wear and tear, aging, and improper handling, as well as lighting. The warranty expires if the buyer further processes or modifies products despite obvious defects.
  5. BSC / Bayirli Swiss Company or its commissioned third-party partners may, at their discretion, fulfill the warranty by providing free repair or equivalent replacement. Further claims are excluded; in particular, there is no right to delivery for pickup orders. For reduced-price goods, BSC / Bayirli Swiss Company reserves the right to refund the purchase price paid instead of providing free repair or equivalent replacement.
  6. The collection and processing of the buyer’s personal data by us is explained in the privacy policy. This forms an integral part of these General Terms and Conditions.

The buyer consents to the storage of the personal data they provide to us as part of an order or otherwise for the purpose of processing the contract. The buyer agrees that we may share their personal data with other companies of the BSC / Bayirli Swiss Company. The buyer also agrees that the data they provide and other usage data may be analyzed in order to present personalized advertising and/or special offers and services. The analysis of usage data may lead to the creation of user profiles. User profiles are created in pseudonymized form and are not merged with personal data. Finally, the buyer consents to us or third parties commissioned by us obtaining a credit report if necessary (credit and business information agency, residents’ registration office, debt collection offices, etc.). We are also entitled to record any information regarding the rejection of a membership application, payment arrears, or misuse.

  1. All prices are net prices. Excl. or inclusive of VAT is always stated. The consent of both parties is required for the offsetting of claims. A reminder fee will be charged for reminders. A fee will be charged for paper invoices; the fee can be obtained from buchhaltung@bsc-online.ch.
  2. The products remain the property of BSC / Bayirli Swiss Company until the purchase price has been paid in full. BSC / Bayirli Swiss Company is entitled to arrange for registration of the retention of title in the register at the buyer’s expense if it considers its claim to be at risk.
  3. The delivery or collection of the ordered products is agreed between the buyer and BSC / Bayirli Swiss Company. If delivery to the buyer’s address is agreed, it will generally be made to the home if the local and structural conditions permit this under normal, expected circumstances. If additional equipment (e.g., facade lift/mountain railway) is required, the buyer must notify the buyer in advance and bear any additional costs. If delivery to the curb is agreed, delivery will be made to the curb. the specified delivery address, provided that this road is accessible by truck. If the road is not accessible by truck, only a delivery to Delivery is due to the location closest to the delivery address that is accessible by truck. Risk is transferred to the buyer upon unloading of the ordered products at the roadside. If assembly has been agreed, this will also only be carried out if the structural conditions allow it under normal circumstances. Lighting and electrical installations are excluded from assembly.
  4. Ordered products are usually made available/delivered within the agreed delivery date. The buyer will be notified if a product is temporarily unavailable. The buyer acknowledges that delivery delays of up to two months do not entitle them to refuse acceptance of the ordered goods, to cancel the contract, to claim damages, or to reclaim the purchase price. Counterclaims by the buyer can only be made with our consent.
  5. If we ourselves are not supplied by our suppliers through no fault of our own, even though we have placed identical orders with reliable suppliers, we shall be released from our obligation to perform and may withdraw from the contract. We will inform the buyer immediately of the unavailability and, in the event of withdrawal, promptly refund any payments already made.
  6. All cases of breach of contract and their legal consequences, as well as all claims of the buyer, regardless of the legal basis, are conclusively regulated in these Terms and Conditions. Other claims of the buyer – regardless of the legal basis – are excluded, except in the cases stated below. BSC / Bayirli Swiss Company, its auxiliary persons, and any vicarious agents are not liable for damages that did not arise from the goods themselves, in particular not for consequential damages, lost profits, or other financial losses. The above limitation of liability does not apply in the event of injury to life, body, or health; in the event of intentional or grossly negligent breach of duty; in the event of a warranty promise, if agreed; and to the extent that the scope of application of the Product Liability Act is open.
  7. We reserve the right to assign or pledge any outstanding purchase price claims against you arising from the delivery of goods, including any partial payment installments, default interest, and reminder fees, to third parties.
  8. We voluntarily grant the buyer a right of return. The return period is fifteen (15) days. Further information on the right of return, the terms of return, and exceptions to the right of return, particularly for customized orders, can be found under the article “Right of Return.” The right of return applies to all sales channels.
  9. Swiss law applies exclusively. The application of the UN Convention on Contracts for the International Sale of Goods is excluded. The place of jurisdiction for natural persons is Suhr or the buyer’s place of residence. The place of jurisdiction for legal entities is Suhr. Supplementary Terms of Use for bsc-online.ch
  10. Scope
  11. The website www.bsc-online.ch (hereinafter “Website”) is operated by BSC / Bayirli Swiss Company (hereinafter “Bayirli Swiss Company”). These Supplementary Terms of Use for bsc-online.ch (hereinafter “Terms of Use”) apply, in the version current at the time of conclusion of the contract, to all business relationships between the buyer and BSC / Bayirli Swiss Company in connection with the use of the website and orders of products and services via the website. They form an integral and complementary part of all orders placed via the online shop.
  12. In addition to or together with these Terms of Use, the General Terms and Conditions of BSC / Bayirli Swiss Company also apply to purchases made via the website, which apply to all purchases regardless of the sales channel. The following Terms of Use contain exclusively website-specific provisions.
  13. We may change these Terms of Use at any time. The version valid at the time of a purchase or order shall prevail.
  14. Registration / Data Protection
  15. It is up to the buyer to register for bsc-online.ch or to place an order without registration. However, certain website functions are only available to registered buyers.
  16. When registering, i.e., opening a customer account, the buyer is obligated to provide truthful personal information. BSC / Bayirli Swiss Company reserves the right to delete customer accounts at any time and without giving reasons, or to block a username and password.

  18. Offers
  19. The online presentation is non-binding. We reserve the right to modify the product range and its presentation at any time and to remove certain products from the offer entirely. We exclude all liability for typographical errors, incorrect, or incomplete information and representations.
  20. Decorative items depicted in connection with a product are not part of the product range unless specifically listed and mentioned. Accessories and decorative items must be purchased separately.
  21. We strive to ensure the best possible availability of the products offered on the website. However, the presentation of a specific product on the website does not mean that we guarantee its availability. We are only obligated to deliver goods in stock. If ordered products are not available, we may not be able to fulfill the order in full. We reserve the right to either cancel the order or only make a partial delivery. In such a case, we will notify the buyer accordingly.
  22. Conclusion of Contract / Order Process
  23. If the buyer places an order via the internet, email, mobile, telephone, or fax, they make a binding offer to conclude a purchase contract. The buyer will receive confirmation that the order has been received. This confirmation does not constitute acceptance of the offer by Bayirli Swiss Company. BSC / Bayirli Swiss Company reserves the right to reject the order without stating reasons. A legally binding purchase contract is only concluded upon dispatch of the order confirmation by BSC / Bayirli Swiss Company.   24. The contract is only concluded for those products expressly listed in the order confirmation. This also conclusively determines the scope of services.
  25. Geographical Validity of Our Offers and Prices; Invoicing; Recycling
  26. Shipping, delivery, and assembly costs are displayed separately during the ordering process and are transparently disclosed in the order overview and in the order confirmation. Further information on shipping, delivery, and assembly costs, as well as delivery options, can be found on the website under the Delivery Conditions.
  27. Our offers are valid for Switzerland and Liechtenstein. For orders with delivery addresses outside of Switzerland and Liechtenstein, the stated delivery prices and flat rates are not valid. Please inquire about our shipping or delivery conditions for such orders. Our online support team (+41 78 200 22 77) will be happy to provide you with an attractive offer.
  28. The advance recycling fee (ARF) is already included in all prices for electronic devices. This contributes to the environmentally friendly disposal of lighting.
  29. Payment
  30. BSC / Bayirli Swiss Company accepts the payment methods displayed to the buyer during the ordering process. Further information can be found under the Payment Options.
  31. The purchase price, as well as any applicable shipping and assembly costs, will be charged after order confirmation. When paying by credit card, the relevant amount will be blocked or reserved at the time the order is placed. However, the actual charge will also be made upon our order confirmation.
  32. If the buyer chooses prepayment as the payment method, the order will only be processed after receipt of payment. Delivery times may be delayed accordingly.
  33. Discounts or vouchers are only accepted under the terms and conditions displayed on the voucher. A voucher code or value is entered during the payment process. Discounts not claimed cannot be granted retroactively. Discounts cannot be combined.
  34. Purchase on Account
  35. If you select the “Purchase on Account” payment method, Availabill AG will check your creditworthiness to determine whether you can be granted payment on account.
  36. In this case, we assign the (purchase price) claim to Availabill AG – after which all payments must be made exclusively to Availabill AG in order to discharge your debts. Availabill AG will send you a payment order containing the recipient’s account and other payment information. You are hereby informed of this assignment of claims and agree to it by accepting these Terms and Conditions and choosing the payment method “purchase on account.”.
  37. The (purchase) contract for the goods (and/or other services) is concluded exclusively between you and BSC / Bayirli Swiss Company. The processing of the purchase contract is also determined by the agreements you make with us. In particular, we remain responsible for general customer inquiries (e.g., regarding goods, delivery times, shipping), returns, complaints, warranty claims, and any contract withdrawals.
  38. If you are in default of payment, Availabill AG may demand compensation for the resulting damages (in addition to default interest) for each reminder sent. If Availabill AG’s internal dunning process is unsuccessful, Availabill AG may refer the outstanding debt to a debt collection agency for collection. In this case, you may incur costs for legal proceedings by debt collection agencies and, if applicable, for legal representation.
  39. Return Policy
  40. Returns are possible within 15 calendar days of in-store pickup, or from the date of the postmark or the delivery or receipt confirmation. If the buyer cannot present the delivery or receipt confirmation, the 15-day period begins from the date the order is shipped.
  41. No Return Policy:
  42. The following are excluded from the return policy (but not from warranty claims):
  43. Custom-made/personalized items or items assembled according to customer specifications
  44. Electrical items that have been put into operation, such as lights.

  47. Damaged items (subject to warranty according to sections 2 to 5)

  50. Specially marked products from clearance or sale promotions
  51. Refund value:
  52. For a full refund of the purchase price, the product must be returned with the original packaging opened or unopened, but in any case with the original packaging undamaged, and in new, unused condition with all accessories.
  53. If the original packaging of undamaged and unused goods is damaged, a processing fee of 20% or at least CHF 100 of the purchase price will apply. The purchase price (less additional, delivery, and shipping costs) will be credited or refunded using the same method of payment.
  54. Return shipping costs:
  55. The buyer is responsible for the return shipping costs.

  57. Use of this website does not imply that the purchaser is granted any license rights to the intellectual property rights in the content of this website.

This website and all content posted there (including, but not limited to, software, files, designs, graphics, and data) are and remain the property of BSC / Bayirli Swiss Company – or BSC GMBH holds the corresponding rights of use – and are protected by applicable intellectual property laws, including copyright and trademark rights. Any unauthorized use of this website, including, but not limited to, the use of this website or its content for professional or commercial purposes of any kind, as well as the reproduction, display, distribution, circulation, distribution, modification, licensing, sale, or any other exploitation of this website or its content, text, text fragments, static or animated graphics, audio data, software, goods or services, and other data or information, is expressly prohibited without the prior written consent of BSC / Bayirli Swiss Company. In particular, methods such as framing and inline linking of the website and its content are prohibited.
